Acceptance of the Terms of Service

When we say "Services," we mean everything Tempopoint offers—the website, the ranked gameplay system, all of it. This agreement is between you (or your kids, if you're letting them use it) and us at Tempopoint. These Terms spell out how you can use what we've built. By using the Services, you're saying you accept these Terms. That goes for you and anyone under your care too. If you don't agree with them, don't use the platform.

Modifications to the Terms of Service and to the Services

We might update these Terms whenever we feel like it. When we do, the changes go live right away on the Services. It's on you to check back now and then so you know what's changed. Keep using the platform after we update something, and you're basically saying you're okay with it. The Services themselves might change too—features get added, removed, tweaked. If something goes down or stops working for a bit, that's just how it goes. We're not liable if you can't access things at any given moment.

Use of the Services

Your information matters to us, and we take steps to protect it from getting lost or stolen. But your part in this is just as important. You control how the Services get accessed from your devices, and anyone who uses them through your connection needs to know and follow these Terms too. Make sure any info you give us is real and current. If something changes about you, let us know right away. Here's the thing though: the internet isn't totally secure. We do what we can, but we can't promise nothing bad will ever happen to your data. Any risk when you send stuff to us is yours to take. We're not responsible if someone figures out how to get around our security or privacy settings. Don't try to break into the Services or mess with how they work. That includes accessing stuff you shouldn't, trying to get past our security, slowing things down for other players, stealing packet headers, disrupting network services, using bots or automated tools to access things, injecting viruses or malware, launching denial-of-service attacks, or basically anything else that would break the system.

Account Set-up and Subscription Services

Want to get into ranked gameplay and community features on Tempopoint? You'll need an account. That means picking a username and password. You've got to be at least 18 to set one up. You can also log in through Apple ID or Google if you prefer. Whatever you do, don't share your login info. Everything that happens on your account is on you. We can shut down your access or delete your account whenever we want, for any reason or no reason at all. A Subscription gets you into ranked features and seasonal stuff. You can grab one from our site or through the App Store or Play Store. Once you've got a Subscription, you can use it on multiple devices. You don't actually need one to use the Services—some things are locked behind it, but plenty isn't. Subscriptions come in three flavors: one month, three months, or a year. Pick your period and pay the fee we ask for. We can change how much it costs anytime we want, but we'll give you written notice and it won't kick in until your current period ends. Your Subscription auto-renews when it expires unless you cancel before that happens. Each renewal lasts as long as the period before it. Payment goes through whatever method the payment processor allows. When you buy, you're saying we can automatically charge you at the start of each Subscription Period. No payment? No ranked access. Cancelling is easy. Do it anytime, and it stops at the end of your current period. If you bought through our site, go to Account Settings. If it was through the App Store or Play Store, use their subscription management. You can still play until your period ends. After that, no more charges.

Intellectual Property Rights and Ownership

Everything in the Services—the code, the text, the graphics, the videos, the sounds, the designs, the leaderboards, the difficulty modes, the beat mappings, all of it—belongs to us and is protected by copyright, trademarks, and other laws that keep intellectual property safe. The logos, names, and designs you see are either ours or someone else's. You can't use them without permission from whoever owns them. Using them without permission is infringement and could get you in legal trouble. The Services are just for you to enjoy personally. Don't sell access to it or use it for business. Don't strip out copyright notices or trademark information. Don't modify, copy, spread around, make derivative versions of, display publicly, download and hoard, or pass along any of our stuff unless we've explicitly said you can or the law says it's okay. We do allow a couple of things, though: Your browser can cache what you're looking at temporarily. You can download and print a reasonable amount of content for personal use, as long as you don't remove our notices and as long as we agree it's reasonable. If we've linked to social media, you can do whatever those platforms let you do. If you break these rules, your right to use the Services ends immediately. We might ask you to give back or destroy any copies you made. You don't own anything here. Every right we haven't explicitly given you stays with us. Breaking these rules means you're infringing on copyright and trademark law, and that could come back to bite you.

User Submissions and Conditions of Use

We don't ask for confidential or proprietary stuff through the Services. But if you do send us materials, artwork, bug reports, information, or ideas, you're saying it's all original to you, nobody else has rights to it, and you're giving us a non-exclusive, fully-paid, royalty-free, unrestricted, perpetual, irrevocable, transferable, assignable, sublicensable, worldwide license to use it however we want—reproduce it, modify it, adapt it, publish it, perform it, display it, distribute it, sublicense it, make derivative works, sell it, use it commercially or not, whatever we decide, no compensation to you, and we don't have to credit you. We don't guarantee we'll keep your submissions around. We might delete them anytime. When you use the Services or send us stuff, you're promising it won't: Break any law. Violate the terms of any linked site or social media platform. Contain anything that's exploitative, obscene, harmful, threatening, abusive, harassing, hateful, sexually explicit, violent, inflammatory, or discriminatory toward any group. Same goes for anything we just think is objectionable. Involve stalking or trying to exploit anyone (especially kids) by exposing them to inappropriate content or asking for personal info that's not allowed by law. Include false, inaccurate, or misleading information. Make it seem like we said or endorsed something when we didn't.

Enforcement, Suspension, and Termination

We can take whatever action we think is necessary about any submission or breach of these Terms. We might involve law enforcement or a court, or we might tell whoever got hurt about what happened. We'll cooperate fully with law enforcement and court orders asking for information about users. We can shut down your access to the Services or parts of it anytime, for any reason or no reason at all. You're waiving the right to come after us, our subsidiaries, affiliates, directors, officers, employees, agents, service providers, contractors, licensors, licensees, suppliers, and successors for anything we do during an investigation or when law enforcement gets involved.

No Reliance

What we put on the Services is general information. Don't treat it as advice you should follow. Get proper professional guidance before you make decisions based on what you read here. We try to keep things current, but we're not making any promises that what's on the Services is accurate, complete, or up to date. Using the Services is your risk. We're not responsible for what happens when you use it.

Privacy

Using the Services means you're okay with us collecting, using, storing, sending, and sharing your information the way our Privacy Policy describes. If you don't agree with that policy, don't use the platform.

Third-Party Websites

We might link to other sites, but we're not responsible for what's on them. If you click through and visit them, that's on you. We don't control those sites and aren't liable if something goes wrong. You're bound by their terms, not ours. You're welcome to link to us, but do it fairly and legally. Don't make it look like we're endorsing you when we're not, and don't frame our site inside yours. We can pull the plug on your linking permission anytime without warning. If you're linking to us without permission or framing us, we're going to ask you to stop, and you're agreeing to do it right away.

Online Purchases

Shopify and Stripe handle all the transactions for us. They've got their own terms and privacy policies that we don't control. Before you buy anything, take a look at what they say.

Copyright Complaints

Copyright infringement is serious to us. We've set up a process for handling complaints about it. If you think your copyright got ripped off, send a written claim to the email or address at the bottom of these Terms. Your notice needs to include all of this: your signature (electronic or physical); a description of the work you think got copied; where on our site the infringing material is; your email, mailing address, and phone number; a statement that you genuinely believe the use isn't authorized; and a statement under penalty of perjury that everything you're saying is true and that you own the copyright or are authorized to act for the owner. Think we took something down by mistake? Send us a counter-notice with the same contact info. Include your signature; what got removed; a statement under penalty of perjury that you believe removal was a mistake or the material was misidentified; your full name, email, mailing address; and confirmation that you'll accept service from the person who complained. You're also agreeing to let the Federal District Court in your area (or Ontario if you're outside the US) handle any dispute.

Disclaimer of Warranties

Using the Services is on you. Everything here—the Services, the content, anything you find or buy through it—comes as-is and available as-is. We're not making any promises about it, implied or otherwise. That includes no promises about whether it's fit for what you want or whether it actually works right. (This doesn't wipe out any guarantees the law says we have to give you.) We're not saying the Services are complete, secure, reliable, suitable, accurate, current, or available. We're especially not saying it'll work without errors, that problems will get fixed, that our servers are virus-free, or that things will run smoothly. We can't promise that files you download won't have viruses or harmful code. You're responsible for your own computer security. We're not liable for damage from denial-of-service attacks, viruses, malware, or anything else that corrupts your system or data from using the Services or downloading stuff from it.

Limitation on Liability

We're not liable for indirect, consequential, special, or punitive damages of any kind—lost money, lost data, lost business, emotional distress, pain and suffering, nothing—whether from a contract dispute, negligence, or anything else connected to the Services. This applies even if you were told it might happen. Our total liability to you for anything related to the Services can't exceed what you've paid us in the month before the problem came up. (This doesn't apply if the law won't let us limit it.)

Indemnification

You're agreeing to defend us and cover our costs if you break these Terms or use the Services in a way you shouldn't. That includes legal fees and covers us, our affiliates, and our partners. It applies to whatever you submit, third-party sites, any misuse of the content, and anything else that violates these Terms.

Governing Law and Choice of Forum

These Terms and the Services are governed by the laws of Ontario and Canada, not by the laws of wherever you live. Any lawsuit comes in Ontario courts, and you're agreeing to that. You're also waiving the right to be part of a class action lawsuit against us.

Waiver

If we don't enforce a right we have, that doesn't mean we're giving it up. We can still use it later.

Severability

If one part of these Terms is invalid or unenforceable, the rest still stands.

Entire Agreement

These Terms and our Privacy Policy are the whole deal between you and us about the Services. Everything else—previous conversations, agreements, promises—is gone.
